General Terms of Sale
Article 1 - Purpose
Fragonard offers activities "Perfumer's Apprentice workshops", "Olfactory talks", and "Connoisseur visits" for individuals on its website: www.fragonard.com
. The activities summary, their locations, dates, and schedules are available on the website. The purchase of one or more activities implies the customer's full acceptance of the general terms and conditions of sale in force on the date of enrollment in the course, as they appear on the Fragonard website. The customer guarantees that he or she is legally competent to duly contract the products and services Fragonard offers on www.fragonard.com
Article 2- Workshop Registration:
Enrolling in activities is done on the Fragonard website within the limit of places available. Individuals may register on the website www.fragonard.com as long as the activity is available on line. Activities will be guaranteed for a minimum of on (1) participant. Registration will be regarded as definitive upon receipt of an e-mail confirmation from Fragonard, nevertheless in cas of payment failure it shall be rejected. Fragonard reserves the right to cancel a reservation if the customer's identity or e-mail address is inaccurate. In this case, the customer will be refunded in full without penalty. Fragonard will also cancel one's reservation in case of payment failure. Every entry in a workshop room is subject to a reservation and a payment in advance.
Article 3- Fees and methods of payment:
The price of the activity is the price that appears on the Fragonard website on the day that the reservation is made. Prices are expressed in euros and include tax. The activity may be paid for when booking online using a debit or credit card: Visa, Mastercard. Bank cards issued by banks domiciled outside of France must be international cards. Fragonard uses SSL encryption. None of this information is sent unencrypted over the internet. Fragonard shall not be liable for any damages arising from the use of and payment for the workshop by bank card.
Article 4- Right to cancel or modify the reservation:
According to articles L.121-18 and L.121-19 of the French Consumer Code (Code de la Consommation), the customer has the right to change or cancel his or her reservation within 7 (seven) days after the confirmation email is sent. Nevertheless, the customer has until 48 (fourty eight) hours before the scheduled date to modify his or her reservation (date, time, location and number of participants) by contacting the Workshop Service of Fragonard (email@example.com) and it remains subject to availability in the schedule offered by Les Parfumeries Fragonard and subject to a payment of any involved additional fees. Cancellation is free of charge up to 48 (fourty eight) hours before the beginning of the workshop. It is mandatory to contact the Workshop Service of Fragonard (firstname.lastname@example.org) to process. Beyond that point, no refund will be offered.
Article 5- Liability:
Fragonard reserves the right to cancel an activity in the event of force majeure without incurring any liability. In this case, however, the customer may choose a new date or request a refund without penalty. Activities involve the active participation of the customer. The latter agrees to be vigilant and to comply with the hygiene and safety instructions given by Fragonard so the activity runs smoothly. Fragonard shall not be liable for damages to person or property during the handling of products and objects during the activity. Fragonard shall not be liable for any damage or loss of objects or personal belongings brought by the customer. The customer is permitted to take home and use the eau de toilette created during the course under his or her own liability and in compliance with these general terms and conditions of sale, especially regarding the section on Property. Children are only permitted from age 12 upwards and are under the sole resposability of a paying adult. All persons present in the classroom must reserve and prepay for entry.
Article 6- Property:
The reproduction, representation, or publication of activities offered by Fragonard is strictly prohibited. The methods, expertise, illustrations, exercises, applications, and content taught in the workshops are the full, complete, and exclusive property of Fragonard.
Article 7- Confidentiality and personal information:
The information collected during the booking of a course is handled electronically in a manner that is designed to improve monitoring of the reservation. Les Parfumeries Fragonard works to ensure that these informations remain confidential. Iinformation is not communicated to potential business partners nor to third parties without the express prior consent of the customer. Les Parfumeries Fragonard may use the information collected to later send sales offers to the customer and keep the customer informed of products, services, and events offered by Les Parfumeries Fragonard. The website www.fragonard.com and the data file collected from it are registered with the French National Commission for Information Technology and Liberties (CNIL, Commission Nationale de l'Informatique et des Libertés) under number 1018180. According to the "Information technology and liberties" (informatique et libertés ) convention of January 6, 1978 amended in 2004, the customer has the right to access and correct information about him or her. This may be done by contacting Les Parfumeries Fragonard - BP 22060 - 06132 Grasse Cedex - France.
Article 8- Dispute:
These general terms and conditions of sale are subject to French law. All claims made in connection with an activity must be addressed in writing to Fragonard - BP 22060 - 06132 Grasse Cedex - France, or by e-mail at email@example.com.
The data recorded on the website www.fragonard.com may be used as proof of communication between the parties, of reservations made by the customer, and of transactions conducted between Les Parfumeries Fragonard and the customer. All disputes and litigation between Fragonard and the customer relative to these general terms and conditions of sale fall under the jurisdiction of the French courts.
