General Terms of Sale

The following General Terms of Sale apply to all sales made on our website www.fragonard.com to the exclusion of all other documents. Online purchases may be made by residents of the U.S., for delivery to clients in the U.S.

Fragonard reserves the right in its absolute discretion at any time and without notice to remove, amend or vary any of the content that appears on any page of this site. Should you note any inaccuracy, please report it to the following address: fragonard.usa@fragonard.com

1. Ordering

If you wish to cancel or modify your order, please send an email as soon as possible to fragonard.usa@fragonard.com. We will make every effort to accommodate your request; however, once a product has left our premises for shipping, the purchase cannot be cancelled or modified until the product has been returned to us. In this case, please refer to our return policy and return your purchase once you have received it.

2. Confirmation and tracking of online orders

By clicking on the "validation" (confirmation) button you confirm your order and can print out your order form. Any confirmation of order is thus irrevocably considered as acceptance of the characteristics of the ordered products or gift card, as well as of the present General Conditions of Sale.
In return, we will send you an email within 24 hours confirming that we have received your order and quoting your order number and the total amount payable. This document validates the transaction.

In addition, Orders placed on the website may be delivered by one of the following carriers such as FedEx, USPS or UPS. Therefore, tracking availability may vary depending on the type of item you purchased, the shipping method you selected and the carrier that is delivering your item(s).

3. Prices

a) Prices displayed on the website are quoted in U.S. dollars.

While we try to ensure that all prices on our website are accurate, errors may occur.

Our prices are subject to change at any time without prior warning.

If we discover an error in the price of the merchandise you have ordered, we will give you the option of reconfirming your order at the correct price or canceling it.

If we are unable to contact you, we will treat the order as cancelled.

All items are invoiced on the basis of the price applicable at the time the order is placed.

b) Sales Tax.

Fragonard charges state, local and county taxes on online transactions, as required by applicable laws.
Please note that your on-screen transaction total reflects estimated tax.

The actual sales tax will be calculated when your order is shipped and may vary from the estimated tax.

4. Postage and Packing

A charge of $15 (except for sending e-gift cards and Alaska, Hawaï and Porto Rico : $40) for packing, insurance and postage is made for each order.

At this time, delivery from this site is available in the United States only.

At Checkout, you will be prompted to choose a shipping method for your item(s). (Please note, some items may offer only one shipping method.)

Shipping costs are dependent on the items in your order and the shipping method you select.
Your total shipping charges will automatically compute during checkout prior to the completion of your order.

Delivery of your items can take anywhere from 2 to 6 full business days from when the product leaves the warehouse, depending on your location and the shipping method you select, and up to 25 business days for deliveries to Hawaii, Alaska and Porto Rico.

Your order must be received and clear credit authorization by 12:00 p.m. (noon) EST.
Orders received and/or processed after that time will not be processed until the following business day.
Business days are Monday - Friday, excluding federal holidays within the United States.

5. Delivery

Products: 
Parfums Fragonard Inc. cannot be held responsible for any direct or indirect results of disruptions (strikes, etc.) to postal and/or transport services.

The delivery address is the one you filled in on your order form.

Parfums Fragonard Inc reserves the right to comply, totally or partially, an order for a State where they have specific distribution agreements, or where there are specific local regulations. In that case you will be informed by Parfums Fragonard Inc.

Delivery to PO Boxes or to the Armed forces are not possible.

Title to any products you order on this website, and risk of loss or damage to products, passes to you on delivery of the products, provided that we have received payment in full for the products.

Please note that these delivery times are only indicative and are subject to availability. Fragonard Inc. cannot be blamed or held responsible for the delivery delay 

E-Gift cards
The delivery of the e-gift card is done through 2 different processes:
- by sending the e-gift card to the email address of the beneficiary indicated by the Customer,
- by allowing the customer to: view their gift card(s) order on the Your Orders page and send it (them) back to the recipient

It is expressly agreed that Fragonard has fulfilled its delivery obligation once the gift card has been delivered by one of these two processes.

The sending of an e-gift card to the beneficiary is done within 1 (one) hour after the payment of the order. 

Under no circumstances shall Parfums Fragonard Inc be held responsible for any entry errors made by the Customer, in particular delivery data, the electronic address of the Beneficiary of an e-gift card or a problem with his or her box and the consequences thereof, in particular the non-delivery of the order. It is therefore recommended to the Customer to check his or her input before validating the order.

6. Payment

Payment must be made when the order is placed, before the goods are dispatched.

Online Payments

By Credit Card

Parfums Fragonard Inc. accepts the following forms of payment for online purchases: Visa Mastercard and American Express. During the final stage of placing your order you must enter the number of your Credit Card and its expiration date (you must never enter your PIN number). This information is entered in encrypted sections and all information transmitted is encoded. We use SSL data encryption and we take reasonable commercially available technical measures to assure that none of this information circulates on the Internet in unencrypted format. The transaction will be charged to your credit card only after we have verified your card details, received credit authorization, and confirm stock availability, and your order is ready to be shipped. Your credit card will not be charged at the time you submit your order.

ATTENTION: Online payment by Credit Card only accepted for order value lower than 250 Dollars. For an higher amount, please pay with Paypal.

PAYPAL online payment

Pay for your order directly on our online shop via PayPal. During your order's final validation stage, click on the PayPal logo and you will be automatically redirected to the website.
 

Payment by Fragonard Gift Card

Except for the purchase of the gift cards themselves, you can pay for your order directly on our online store with a Fragonard Gift Card by entering the number indicated on the card.

Payment in cash, CODs, checks, money orders, gift certificates or electronic gift cards is not accepted.

N.B. If payment does not cover the full value of the order, only the goods paid for will be dispatched.

Fraud Prevention

In order to limit fraud and in its customers' interest, Fragonard monitors all orders placed on its site. Should any doubt arise as to the authenticity of an order, Fragonard reserves the right, prior to completing the transaction, to require you to prove your identity (via a passport, French identity card, or driver's licence with photograph), your place of residence and the means of payment used. In this event, your order will be processed once these documents have been provided. We reserve the right to cancel your order if no documents are provided within five days, or if the documents provided are deemed irregular.

7. Products

a) The list of products displayed on our website is not exhaustive.

The photographs depicting our products are displayed for information only and do not constitute a contract.

b) All products from this website are subject to availability; as necessary, we reserve the right to limit the quantity of products we supply; supply only part of an order or to divide up orders.

We also reserve the right to alter the terms or duration of any special offers or sale promotion.

c) If any items are out of stock or otherwise unavailable after you have placed your order, our Customer Services Department will contact you.

The items available will be dispatched. In the case of payment by credit card, only the cost of the items dispatched will be charged.

Your invoice details the items dispatched and informs you of the expected dispatch date for the items not immediately available.

If none of the items ordered are available, you can then either (i) cancel your order, or (ii) affirm the order and your order will be dispatched at a later date.

The conditions of use of the gift cards are specified here.

Please note that the purchase of an e-gift card does not entitle you to any loyalty points. Only placing a product order can earn loyalty points

8. Returns

For Fragonard online purchases, if the product you ordered is not suitable or is defective or is not what you ordered, you may return it within 15 days of receipt, in its original packaging accompanied by the original receipt, to :

Regarding e-cards, you will not be able to exercise your right of withdrawal once the e-card has been fully or partially used to make a purchase. Indeed, any use of the e-gift card is an express and irrevocable waiver of the right of withdrawal.

If an e-gift card has been withdrawn, it will be deactivated.

All shipping and handling charges are non-refundable and payable by you.

We will exchange the product(s) or the e-Card, (postage and packing costs payable by you) or, if you prefer, we will reimburse you in the same from of payment within 15 days following receipt of the returned goods.

9. Data protection

Please report to Fragonard's Privacy Policy.

10. Acceptance of the General Terms of Sale - Governing law

Any purchase implies acceptance of these General Terms of Sale. The Buyer declares that he/she has read them and thereby renounces all recourse to any other document and specifically to his/her own general terms of purchase.

These General Terms of Sale may be modified at any time. The new General Terms of Sale will apply to all sales made after modification of the Terms.

All transactions are governed by the laws of the State of New York, without giving effect to any principles of conflict of laws. Any dispute between us arising out of or relating to the transaction shall be resolved exclusively in a court located in New York, New York.
